TERMS AND CONDITIONS OF USE OF THE SERVICE

DIGITAL ACCELERATION PROGRAM - METAMEDIA CLOUD SERVICES

This document establishes the conditions under which MetaMedia Cloud Services (hereinafter “The Provider”) grants the corporate e-mail infrastructure service to the beneficiary (hereinafter “The Client”).

By confirming the activation of the service via WhatsApp, email, phone call or direct message, “The Client” unconditionally accepts the following terms:

1. NATURE AND DURATION OF THE SERVICE

  • 1.1. Purpose: The objective of this service is to facilitate the digitalization of businesses, providing professional tools for their communication.

  • 1.2. Free of charge: The email hosting service (up to 10 accounts, 1 GB each) and, if applicable, the domain registration (if applicable in the promotion), is granted with a bonus of 100% (FREE) during the first 12 months (1 year) from the date of activation.

  • 1.3. No Forced Commitment: This agreement does not obligate either party to maintain the business relationship beyond the free period. “The Client” is free not to renew at the end of the year, and “The Supplier” reserves the right not to offer renewal.

2. RENOVATION AND COSTS

  • Payment Period: At the end of the 12 months free of charge, if “The Client” wishes to keep the service and its information, he/she must pay the current annual fee.

  • 2.2. Pricing: Renewal costs (currently estimated at $49 USD/year base) are subject to change without notice due to technology market fluctuations or licensing costs.

  • 2.3. Special Domains: Specific domain endings (.mx, .com.mx, .pro, etc.) will have an additional renewal cost that will be notified in advance.

3. DOMAIN AND MIGRATION POLICY

  • 3.1. External Domains: If “The Client” already owns your domain, he/she is the only responsible for the configuration of your DNS. “The Provider” is not responsible for loss of information during external migrations or errors in the configuration outside our servers.

  • 3.2. Domain Name Rebates (Free of charge): If “The Provider” paid for the domain registration as part of the promotion:

    • The domain is owned by the client, BUT its administration and transfer are blocked during the first year of validity.

    • Transfer: The EPP Code will not be released before the expiration of 12 months, unless “The Customer” covers the administrative cost of early release ($49 USD).

  • 3.3. Termination of Service: If “The Client” decides to migrate to another provider, it is his total responsibility to make the backups of his e-mails. Once the service is terminated or the term expires, “The Provider” will delete all the information from its servers and it cannot be recovered.

4. SECURITY AND ACCESS

  • IP blocking: For security purposes, the system will automatically block the IP address of any user after 3 unsuccessful attempts password. Unlocking requires manual request to Technical Support.

  • 4.2. Access to the Control Panel (cPanel/DirectAdmin):

    • The standard service is “Managed” (we configure).

    • If “The Customer” requests direct access to the control panel (root/admin), it assumes full responsibility for the security of the site. If the injection of viruses, malware or misconfigurations resulting from customer mismanagement is detected, the account will be suspended immediately and without notice to protect the integrity of the server.

  • 4.3. Data Privacy: “The Supplier” guarantees that DO NOT access, read, or monitor the content of the e-mails of “The Client”. The information is the exclusive property of “The Client”.

  • 4.4. Illegal Activities: It is strictly forbidden to use the service for illegal activities, fraud, phishing or any act punishable by law. If “The Provider” detects suspicious activity (based on complaints or traffic patterns), it will immediately terminate the service and notify the competent authorities (Cyber Police).

5. ANTI-SPAM POLICY (ZERO TOLERANCE)

  • 5.1. Mass mailings: It is strictly forbidden to use email accounts to send SPAM, unsolicited advertising or mass newsletters.

  • 5.2. Sanction: The detection of SPAM sending will result in the immediate freezing of the account and/or the entire domain to prevent the server IP from being blacklisted. There will be no reactivation of the service in these cases.

6. TECHNICAL SUPPORT AND SCOPE

  • 6.1. Support Included: The free service includes support to ensure that the server is online and running.

  • 6.2. Specialized Support (Extra Cost): Any assistance outside the server operation (e.g. printer configuration, remote support to configure Outlook on client's PC/Mobile, virus cleaning on client's equipment, complex data migration) will be charged with a fee of $50 USD per hour.

7. COMMUNICATION AND MARKETING

  • “The Customer” agrees to receive notifications via WhatsApp and Email related to: service status, security updates, tutorials and. exclusive offers of MetaMedia Cloud Services products (such as web design, Google Ads campaigns, etc.).

8. LIMITATION OF LIABILITY

  • “The Provider strives to maintain an uptime of 99.9%. However, it is not responsible for economic losses, loss of profits or loss of business opportunities resulting from temporary service interruptions, general internet failures or blockages due to customer misuse.

ACCEPTANCE OF THESE TERMS IS DEEMED TO BE CONFIRMED UPON RECEIPT OF THE LOGIN CREDENTIALS AND START USING THE SERVICE.
